What personal data do we collect and where does it come from?
As part of the application process, we process the following personal data:
– Your master data (such as first name, surname, name affixes, date of birth)
– Work permit/residence permit, if applicable
– Contact details (such as private address, (mobile) telephone number, email address)
– Skill data (e.g. special knowledge and skills)
– If relevant to the advertised position: health suitability
– Additional data from the application documents
Your personal data is generally collected directly from you as part of the recruitment process, in particular from the application documents, the interview and the personnel questionnaire.
We also receive data from third parties (e.g. employment agencies).
We also process personal data that we have lawfully obtained from publicly accessible sources (e.g. professional networks).
For what purposes and on what legal basis is data processed?
We process your personal data in compliance with the provisions of the EU General Data Protection Regulation (GDPR).
The primary purpose of data processing is to establish an employment relationship. The primary legal basis for this is Art. 88 (1) GDPR in conjunction with § 26 (1) BDSG.
Your data will be processed exclusively for the purpose of filling the specific position for which you have applied.
In addition, the processing of health data may be necessary for the assessment of your ability to work in accordance with Art. 9 (2) h) in conjunction with Section 22 (1) b) BDSG.
If you would like to be included in our applicant pool in the event of a rejection, we require your declaration of consent.
If you would like your application to be considered for other open positions in the company/group, we require your declaration of consent.
For how long will your information be stored?
If you are hired, we will transfer your application documents to your personnel file. After termination of employment, we will continue to store those personal data that we are legally obliged to retain. This regularly results from legal documentation and retention obligations, which are regulated in the German Commercial Code and the German Fiscal Code, among others. The storage periods are up to ten years. In addition, personal data may be retained for the period during which claims can be asserted against us (statutory limitation period of three or up to thirty years).
In the event of rejection, your application documents will be deleted no later than six months after completion of the application process, unless you have given us your consent to store them for a longer period (applicant pool).
Who gets your data?
Within our company, only those persons and departments (e.g. specialist department, works council, representative body for disabled employees) involved in the decision on your recruitment will receive your personal data.
Within our group of companies, your data will be transferred to Sietzy Gruppe GmbH, as this is where data processing for application procedures for the companies affiliated with the group is carried out centrally.
What rights can you assert as a data subject?
You have the rights set out in Articles 15–21 of the GDPR/Sections 17–23 of the KDG:
